Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Siap. By accessing or using the Siap platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our service.

1. Acceptance of Terms

By creating an account on Siap or by accessing the platform in any way, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms on behalf of yourself or your organisation, and agree to comply with all applicable laws and regulations in Malaysia.

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or within the platform. Your continued use of Siap after such notice constitutes your acceptance of the revised Terms.

2. Description of Service

Siap is a cloud-based, offline-first Field Service Management (FSM) platform designed for Malaysian businesses in the trades and services industries. The platform provides:

  • Job Management & Dispatch: Creation, assignment, tracking, and completion of field service jobs.
  • Offline-First Synchronisation: The ability for field technicians to view and update jobs without an active internet connection, with automatic data sync when connectivity is restored.
  • Invoicing: Generation, customisation, and management of professional invoices for completed jobs.
  • Team Management: Adding, managing, and assigning roles to technicians and administrative staff within your organisation.
  • Customer Management: Maintaining a database of your customer contacts and service history.

We reserve the right to add, modify, or discontinue features at any time with reasonable notice to subscribers.

3. User Accounts & Responsibilities

When you create an account, you are the “Account Owner” for your organisation on Siap. As Account Owner, you accept responsibility for:

  • Maintaining the confidentiality of your account credentials and restricting access to authorised personnel only.
  • All activity that occurs under your account, including the actions and data entries made by technicians and staff members added to your organisation. You are responsible for ensuring your team members comply with these Terms.
  • The accuracy and legality of all data entered into the platform, including customer information and financial records.
  • Notifying Siap immediately of any unauthorised use of your account or any security breach at support@siap.app.

You agree not to use the platform for any unlawful purpose, to upload malicious code, to attempt to gain unauthorised access to other accounts, or to engage in any activity that disrupts or degrades our service.

4. Payment & Subscription

Siap is offered on a subscription basis. By subscribing, you agree to the following:

  • Billing Cycle: Subscriptions are billed on a monthly basis on the anniversary of your subscription start date.
  • Pricing: Current pricing is displayed on our pricing page. We will provide at least 30 days’ notice before any price changes take effect.
  • Taxes: All prices are exclusive of applicable Malaysian taxes (e.g., Sales & Service Tax). You are responsible for any taxes applicable to your subscription.
  • Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Your access to the platform will continue until the end of your current billing period. We do not provide prorated refunds for partial periods.
  • Failed Payments: If a payment fails, we will notify you and provide a grace period. If payment is not resolved within 7 days, we may suspend your account until the outstanding balance is settled.

5. Intellectual Property

The Siap platform, including its software, design, trademarks, and content, is the exclusive property of Siap Technologies and is protected by applicable intellectual property laws.

Your data — including your customer records, job data, and invoices — remains your property. You grant Siap a limited licence to store and process this data solely for the purpose of providing the service to you. We will never claim ownership of your business data.

6. Disclaimer of Warranties

Siap is provided “as is” and “as available” without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or completeness of any content on the platform.

7. Limitation of Liability

To the fullest extent permitted by law, Siap Technologies and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities.
  • Loss of data or business interruption.
  • Errors or omissions in job dispatch or invoicing.
  • Any claims arising from actions taken by your technicians or team members.

In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms exceed the total amount paid by you to Siap in the three (3) months preceding the claim.

8. Termination

We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms, fail to pay subscription fees, or engage in fraudulent, abusive, or illegal activity. Upon termination, your right to use the service will immediately cease. You may export your data from the platform prior to termination. Following account deletion, your data will be purged within 30 days in accordance with our Privacy Policy.

9. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
